Taylor&Emmet hails introduction of new abuse laws

Family law experts at Sheffield’s Taylor&Emmet LLP are welcoming the implementation of new legislation broadening the definition of domestic abuse.

From December 29, “coercive or controlling behaviour” will be recognised as a criminal offence, closing a gap in the current laws and giving police more power to intervene.

Rachel Sharp, a specialist in domestic abuse at Taylor&Emmet, said: “We are pleased to see the criminal justice system recognising that the behaviour of a dominating or jealous partner – man or woman – can be as damaging as physical violence and we hope the introduction of this new law will stop more local families suffering this Christmas.

“The festive season is a particular trigger point for domestic abuse, with incidents at a high, on Christmas and Boxing Day. Although reports to police have increased by 30% in the last two years, many victims are unaware that action can be taken through the family courts if they struggle to provide the evidence needed to secure a criminal conviction.”

Taylor&Emmet helps those suffering physical or psychological abuse obtain a non-molestation order that prevents the perpetrator from using or threatening violence, intimidating, harassing or threatening the victim. It can also apply to children and include an exclusion provision, preventing their partner from visiting the family home for a period of at least six months. If there are no grounds for a court order, a warning letter can still be issued, insisting the violent behaviour stops or further action will be taken.

Rachel added: “We work closely with the police and domestic abuse centres in South Yorkshire and North Derbyshire to give victims the support and guidance they need to take appropriate action against a violent or aggressive partner. Our advice is completely confidential and appointments can be arranged at a time and location that suits the client.”

On average, victims of domestic abuse suffer in excess of 30 incidents before calling the police. All Sheffield officers are trained to handle these situations and the force has a dedicated domestic incident unit.
